This is one of the new offences introduced by the Road Safety Act 2006;
If you drive a mechanically propelled vehicle, (so it refers to other vehicles for example, quad bikes, digging machines and electrically assisted pedal cycles etc, not only motor vehicles), on a road or other public place without due care and attention or reasonable consideration for others using the road or place and a death occurs, even if the authorities suspect it was only a momentary lapse of concentration, then you may be charged with this offence.
This is the one offences where many people with previously unblemished driving records may find themselves in trouble with the authorities for a moments careless driving and which can result in imprisonment.

If you are subject or likely to be subject to a prosecution for this offence, your case can take place in either the Magistrates’ Court or the Crown Court where you can receive a maximum sentence of up to five years imprisonment and a financial penalty along with disqualification from driving.
The new Act also defines what is classed as ‘careless or inconsiderate’ driving which is driving falling below the standard expected of a careful and competent driver and takes into account the circumstances of the incident, what you could be expected to be aware of and your own knowledge relating to the circumstances of the incident.
