death by driving whilst unlicensed, disqualified or uninsured

This is a new offence created by the Road Safety Act 2006.

There are of course offences in their own right of driving other than in accordance with the conditions of a driving licence, driving without any insurance and driving whilst disqualified, but if death is caused whilst doing so, you could face a maximum sentence of two years imprisonment, a fine and disqualification from driving.

Your case can take place at the Magistrates’ Court or the Crown Court and sometimes, this can be your decision and so it is imperative that you get the correct advice at an early stage in the proceedings and if possible, as early as the police station stage.
