We’ve all got one! But … it’s an offence to drive a motor vehicle on a road whilst using a hand-held mobile telephone or a specified hand-held device.

If you use your phone when you are driving, did you know that the minimum penalty is 3 points on your licence and a financial penalty?

So if your licence is currently endorsed with 9 points or you are a new driver with 3 points already endorsed on your licence, you are at risk of disqualification.

If the police or prosecuting authority thinks that your manner of driving has been affected to fall below a certain standard or you have been involved in an accident as a result of or in connection with using a mobile phone whilst driving your car, they can lay a more serious charge which can result in a more severe penalty.

Most cases that the Courts deal with relate to issues over actual ‘use’ of the phone and whether the individual’s circumstances constitute ‘use’.

There are ways of challenging the evidence so why not call us and discuss the options open to you?
